The Service is operated by Crossbar Holdings Inc. ("Crossbar," "we," "us," or "our"). By accessing or using the Service, connecting a wallet, signing a message, submitting a transaction, creating a profile, joining a campaign, or otherwise interacting with DopeRaider, you agree to these Terms. If you do not agree, do not use the Service. ## 1. Risk-to-earn notice DopeRaider is a risk-to-earn game. That means gameplay may involve strategic risk, market risk, timing risk, transaction fees, network fees, failed transactions, lost opportunities, loss of inventory, loss of position, loss of game progress, loss of digital assets, or other unfavorable outcomes. DopeRaider does not guarantee profit, income, yield, rewards, token appreciation, return of funds, return on time, market liquidity, campaign eligibility, leaderboard position, or any other financial or gameplay outcome. You may lose value, spend fees without earning rewards, or make decisions that are unprofitable. Nothing in the Service is financial, investment, legal, tax, or accounting advice. You are solely responsible for deciding whether to play, transact, hold assets, sell assets, claim rewards, or participate in campaigns. ## 2. Eligibility You must be legally able to accept these Terms and use blockchain-enabled services in your jurisdiction. If you are under the age of majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian, unless local law prohibits your use. You may not use the Service if doing so would violate any law, regulation, sanctions program, platform rule, wallet provider rule, or app store policy that applies to you. ## 3. Game content is fictional DopeRaider is a fictional strategy game. References to districts, raiding, contraband, DIRT, exploits, crews, bosses, markets, lockups, and related concepts are narrative and gameplay elements only. They are not instructions, encouragement, approval, or authorization to engage in unlawful activity, cyber abuse, fraud, violence, trafficking, hacking, theft, or real-world harm. You agree not to use the Service to plan, promote, facilitate, or conduct unlawful conduct or real-world harm. ## 4. Wallets and self-custody DopeRaider may require you to connect a wallet, sign messages, approve transactions, or interact with Solana programs. You are responsible for your wallet, private keys, seed phrase, passwords, devices, and transaction approvals. We will never ask for your seed phrase or private key. Do not share them with anyone. If you lose access to your wallet or approve a malicious or mistaken transaction, we may not be able to recover your assets, restore your account, or reverse the transaction. Third-party wallets, mobile wallet adapters, Seed Vault, Phantom, Solflare, Backpack, RPC providers, block explorers, app stores, and other integrations are provided by third parties. We are not responsible for third-party services, outages, policies, fees, security failures, or user experience. ## 5. Blockchain and transaction risks Blockchain transactions may be irreversible. Solana network conditions, congestion, RPC rate limits, wallet behavior, software bugs, validator behavior, token account state, and program state can affect whether a transaction succeeds, fails, confirms, or appears in the app. You are responsible for all network fees, transaction fees, priority fees, taxes, and other costs associated with your use of the Service. We do not guarantee transaction execution, settlement, indexing, finality timing, or continuous access to on-chain state. ## 6. Digital assets and rewards Game assets, test tokens, dummy USDC, in-game balances, campaign entries, referral mechanics, leaderboard positions, Seeker-related eligibility checks, SKR-related references, or other rewards may be experimental, limited, unavailable, changed, paused, cancelled, or subject to additional rules. Unless a campaign states otherwise in writing, rewards are not guaranteed and may depend on eligibility, technical availability, fraud checks, geographic restrictions, app store rules, wallet status, token availability, third-party ecosystem decisions, and our discretion. References to SKR or Solana Mobile ecosystem incentives do not mean that SKR is issued, funded, guaranteed, or controlled by DopeRaider. Any ecosystem reward program may be subject to separate third-party rules. ## 7. No investment relationship Using DopeRaider does not create an investment contract, partnership, employment relationship, joint venture, fiduciary relationship, or agency relationship between you and Crossbar. You should not use the Service with funds or assets you cannot afford to lose. You are responsible for your own due diligence and for complying with applicable tax obligations. ## 8. Accounts, profiles, and referrals You may be able to create or update a profile, alias, avatar, referral link, invite code, or other user-facing information. You are responsible for the information you provide and for activity associated with your wallet, account, or referral link. We may reject, modify, suspend, or remove aliases, avatars, profile content, referral activity, or campaign entries that we believe are abusive, misleading, infringing, unlawful, automated, fraudulent, exploitative, or harmful to the Service or other users. Referral features may change or be discontinued. Referral rewards, fee shares, or campaign benefits are not guaranteed unless expressly stated in a separate written campaign rule. ## 9. Prohibited conduct You agree not to: * Violate any law, regulation, sanctions rule, platform rule, app store policy, or third-party right. * Use bots, scripts, automation, sybil attacks, wash activity, exploit loops, fake accounts, replay attacks, or other manipulative tactics. * Attempt to hack, disrupt, overload, reverse engineer, scrape, bypass, or interfere with the Service, smart contracts, APIs, RPC endpoints, wallets, or other users. * Exploit bugs, pricing errors, campaign mistakes, settlement issues, duplicated claims, or unintended mechanics. * Harass, threaten, impersonate, defraud, spam, or mislead other users. * Upload or link to malware, phishing content, illegal content, hate content, sexually exploitative content, or content that infringes intellectual property rights. * Use the fictional game theme to promote or facilitate real-world crime, violence, cyber abuse, trafficking, fraud, or other unlawful conduct. We may investigate suspected violations and may limit, suspend, terminate, reverse off-chain credits, remove leaderboard entries, block claims, or take other action where permitted by law and technically possible. ## 10. Service changes and availability The Service is under active development. We may update, rebalance, patch, reset, pause, migrate, disable, or discontinue any feature, contract interaction, economy parameter, reward path, campaign, branch, website, APK, API, database, or app store build at any time. We do not guarantee that the Service will be uninterrupted, error-free, secure, compatible with every device or wallet, or available in every jurisdiction. ## 11. Intellectual property The Service, including the DopeRaider name, logos, characters, art, game design, interfaces, text, software, documentation, and related content, is owned by Crossbar or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for personal gameplay and community participation. You may not copy, modify, sell, sublicense, or commercially exploit the Service without our written permission. ## 12. User content If you submit or display content through the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, moderate, and use that content as reasonably necessary to operate, promote, and improve the Service. You represent that you have the rights needed to submit your content and that your content does not violate law or third-party rights. ## 13. Privacy Your use of the Service is also governed by our Privacy Policy, available at: ## 14. Disclaimers THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, ACCURACY, AND ERROR-FREE OPERATION. WE DO NOT WARRANT THAT GAMEPLAY WILL BE PROFITABLE, THAT REWARDS WILL BE AVAILABLE, THAT TRANSACTIONS WILL SUCCEED, THAT DIGITAL ASSETS WILL HAVE VALUE, OR THAT THE SERVICE WILL MEET YOUR EXPECTATIONS. ## 15. Limitation of liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROSSBAR AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST ASSETS, LOST GOODWILL, LOST GAME PROGRESS, FAILED TRANSACTIONS, WALLET COMPROMISES, OR NETWORK FAILURES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF 100 U.S. DOLLARS OR THE AMOUNT YOU PAID DIRECTLY TO US FOR THE SERVICE DURING THE THREE MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. ## 16. Indemnity You agree to defend, indemnify, and hold harmless Crossbar and its affiliates, officers, directors, employees, contractors, agents, and licensors from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your use of the Service, your wallet activity, your content, your violation of these Terms, your violation of law, or your violation of another person's rights. ## 17. Termination We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, created risk for the Service or users, or if required by law, platform policy, app store policy, or third-party provider policy. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including risk disclosures, intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution. ## 18. Governing law and dispute resolution These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Before initiating a formal claim, you agree to attempt to resolve any dispute through good faith negotiation by contacting us at . If the dispute is not resolved within 30 days, the dispute will be resolved by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, except as otherwise stated here. The arbitration will be conducted remotely with a seat in New York, New York, unless the parties agree otherwise in writing. The proceedings will be conducted in English. You and Crossbar agree that claims must be brought on an individual basis only, and not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate claims of multiple users. Either party may bring an individual claim in small claims court if it qualifies. Either party may seek equitable relief in a court of competent jurisdiction to prevent unauthorized use, abuse, or infringement of intellectual property, confidential information, wallets, accounts, systems, or the Service. You may opt out of arbitration and the class action waiver by emailing with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. The opt-out notice must include your name, wallet address if applicable, and a clear statement that you want to opt out of arbitration. ## 19. Changes to these Terms We may update these Terms from time to time. Updated Terms will be posted here with a new "Last updated" date. Your continued use of the Service after updated Terms are posted means you accept the updated Terms. ## 20.
